Garden Plant Shop is an online retailer specialising in a curated selection of perennial plants, fruit trees, and berry plants, bringing the joy of gardening to enthusiasts across the globe (excluding Asia and certain remote regions). Our shop is designed for gardeners who value quality, sustainability, and the beauty of growing their own food and flora.

2. User Obligations and Responsibilities

By using our website, you agree to:

• Provide accurate, current, and complete information during the registration and checkout process.
• Maintain the confidentiality of your account password and any activities that occur under your account.
• Use the website only for lawful purposes and not engage in any fraudulent or harmful activities.
• Ensure that the plants you order are suitable for your local climate and growing conditions; we cannot be held responsible for plants failing to thrive after delivery due to unsuitable environments.

3. Products and Services Description

We offer a variety of live plants and gardening supplies. Our product range includes:

• Live Plants: Including but not limited to Anemone, Fruit Trees (Apple, Apricot, Cherry, Citrus, Fig, Peach, Pear), Berry Plants (Blackberry, Blueberry, Currants, Gooseberry), Grape Vines, and Perennials (Echinacea, Fern, Hosta, Lupin, Penstemon).
• Gardening Supplies: Various tools and accessories to support your gardening journey.

Important Note on Live Plants: Due to their perishable nature, specific live plants (as listed on our Shipping & Returns page) are excluded from our standard return policy. We guarantee their health upon arrival but cannot accept returns once they have been delivered.

4. Ordering and Payment Terms

Placing an Order: You can place an order through our website. All orders are subject to availability and our acceptance.

Payment Methods: We accept payments via Visa, MasterCard, JCB, and PayPal. All payments are processed securely. By providing payment information, you represent that you are authorised to use the chosen payment method.

Pricing: All prices are listed in British Pounds (£) and include VAT where applicable. We reserve the right to change prices at any time, but changes will not affect orders already accepted.

Order Confirmation: After placing an order, you will receive an email confirmation. This email constitutes our acceptance of your order and forms a legally binding contract.

5. Shipping and Delivery

We ship globally, except to Asia and a few remote regions. Please see our Shipping & Returns page for full details.

• Processing Time: Orders are processed within 1-2 business days.
• Shipping Methods:
  • Standard Shipping: £12.95 via DHL or FedEx. Delivery within 10-15 days after dispatch.
  • Free Shipping: Available on orders over £50 via EMS. Delivery within 15-25 days after dispatch.
• You will receive a tracking number once your order is dispatched.

We are not responsible for delays caused by customs, weather, or other events beyond our control.

6. Returns, Refunds, and Exchanges

Your satisfaction is our priority. Our full policy is available on our Shipping & Returns page.

• Returns Period: 15 days from the date of receipt.
• Non-Returnable Items: As stated in Section 3, specific live plants cannot be returned for health and safety reasons.
• Eligible Items: Unused gardening supplies in original packaging may be returned for a refund or exchange.
• Process: Contact our customer service at [email protected] within the 15-day period to initiate a return. A Return Authorization Number is required.
• Refunds: Issued to the original payment method within 5-10 business days for cards, or 3-5 days for PayPal, after we receive and inspect the returned item. Original shipping costs are non-refundable.

All content on this website, including text, graphics, logos, images, and software, is the property of Garden Plant Shop or our suppliers and is protected by international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

8. Limitation of Liability

Garden Plant Shop will not be liable for any indirect, incidental, or consequential damages arising out of your use of the website or the products purchased, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim related to the website or products shall not exceed the total amount you paid for the products in question.

We guarantee that our plants will be healthy upon arrival. However, we are not liable for the success or failure of plants once they are in your care, as this depends on local conditions, planting practices, and weather.

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
